Justice Scalia recently in the University of Hawaii that although he was against the internment he believes that this could happen again if faced with a threat. If America ever again was forced into a war and our borders were threatened by a foreign country there could be a definite chance that America rounds up descendants of that country. This is because of Stare Decisis which is the rule of precedent allowing for previous cases to determine how a court should rule (Thompson). This was also significant because it allowed the United States to be able to forcibly make a group leave an area based on their race. ![]() Therefore giving the military an immense amount of power in such cases. The case affirmed the idea that in times of war the needs of the military must be met. However the land they lost became extremely valuable, costing millions of dollars. Ronald Reagan later authorized congress to give every living person of the internment camps 20,000. Many of the Japanese's land not only was stolen but much of the land was vandalized. Many of the Japanese lost their land by scouters and were unable to retrieve their land after the war was over. Many of the Japanese were promised that there land would be protected. The very high Japanese populations were removed from their land in the west coast. The nation refused to protects the constitutional rights of its citizens. However this was a dark chapter in America's legal history. Although this case was decided in the favor of the military Korematsu's record was later expunged. This why this case has been criticized for allowing racism to occur. ![]() Korematsu was different than any other case in Supreme Court history because it was the only case in this Court's history where even after the Court used a strict test for possible racism, the court upheld the restriction of civil liberties. ![]()
